I. INTRODUCTION

This discovery dispute raises the following related issues — (i) whether or not plaintiff should be required to provide discovery (in the form of responses to defendant’s requests for admission and through the production of documents) concerning the amount of the casualty loss sustained by plaintiff-taxpayer to its timber resources as a consequence of a 1979 hurricane; and (ii) whether or not defendant should be precluded from raising a factual dispute relative to said casualty loss amount.
