In this case the death of the respondent, plaintiff in the action, was suggested by the appellant in this court at the October term, 1888, and on the twenty-third of January, 1889. At the same term, February 5, 1889, the cause was continued on motion of the attorney who had represented the plaintiff prior to his death. At the end of the March term, 1889, it was continued by operation of the general order of continuance made at the close of the term, *98continuing all matters not disposed of.
