This is a civil action arising under the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1001 et seq. Plaintiff Selma Al-Abbas was a participant in a disability plan as part of her employment with International Business Machines Corporation (“IBM”).
