This appeal involves two cases. They have been consolidated for submission to this court. The initial action was for a declaratory judgment wherein it was asked the rights of the parties under a written contract for the sale and purchase of a property be determined. In this case J. A. Tacke is plaintiff and Wilfred J. Hauser is defendant. In the other case J. A. Tacke and Hazel Yoss, joint owners of a residence property, are plaintiffs and Wilfred J.
