— Marión Baker, appellee herein, was the beneficiary of a trust created by the will of his grandfather. The trust was administered as a trust estate by the district court of Cass county. W. E. Baker was named as trustee in June, 1922, and filed with the clerk of said court a trustee’s bond with J. H. Baker and S. H. Albright as sureties. The bond, by its terms, bound not only the sureties, but their “executors, administrators, heirs, devisees, and legal representatives.” Under the terms of the trust, Marion Baker was to receive the fund when he became of age.
