The defendant was indicted and tried in the district court for Scott county, Macdonald, J., presiding, for the crime of embezzlement, in failing and refusing to comply with the demand of his successor in ■the office of county treasurer, to turn over and account for the funds of the county. The jury returned a verdict of guilty, and found the amount embezzled to he $10,736. Defendant appeals from the judgment entered thereon, his motion in arrest of judgment and for a new trial having been denied.

The defendant was indicted for embezzlement. The indictment alleges the election of the defendant to the office of county treasurer of Scott county, at the general election in November, 1877, his qualifying and entering upon the discharge of his duties on the first day of March following, and that he continued in such office until the 21st day of June, 1880.
