Plaintiff in error, William J. Drea, (hereafter referred to as petitioner,) filed a petition for mandamus against the Retirement Board of the Policemen’s Annuity and Benefit Fund and the persons composing said board. The petition alleged, in substance, that after completing a service of twenty years as a policeman in the city of Chicago he tendered his resignation on the 9th day of April, 1917, and filed with the board of trustees of the police pension fund his application for a pension.
