Lippmann, J.), entered October 14, 2005, which, in an action for personal injuries sustained in a subway station, granted the motion of defendant Metropolitan Transportation Authority (MTA) for summary judgment dismissing the complaint, and denied plaintiffs cross motion to amend his notice of claim and summons and complaint nunc pro tunc so as to name the New York City Transit Authority (TA) in lieu of MTA, unanimously affirmed, without costs.
