This cause is before this Court on an appeal, as of right, from the October 12, 1995, final judgment of the United States Bankruptcy Court for the Middle District of Florida. The Bankruptcy Court granted Debtor, Miller Cooper’s, Motion for Summary Judgment and allowed Debtor to avoid a judicial lien on his homestead in a case arising under the Bankruptcy Code in a Chapter 7 proceeding.
