ORDER
BLATT, District Judge.
The plaintiff filed his original complaint on March 22, 1971, alleging that the defendant’s refusal to hire him in December of 1966 was because of his race and was, therefore, a violation of Title VII of the Civil Rights Act of 1964 [42 U.S.C. § 2000e et seq.]. The defendant filed a timely motion to dismiss, and the plaintiff then filed an amended complaint. His amended complaint alleges (1) a cause of action under the Civil Rights Act of 1866 [42 U.S.C. § 1981] as well as under Title VII of the 1964 Civil Rights Act, (2) that the suit is brought as a class action “…
