This suit in the court below was on a note under seal dated March 3,1898, payable one day after date in the sum of $3,700 with power of attorney to confess judgment. The note pur*609ports to be drawn by Solomon C. Groff in favor of his son’s wife Maria Groff. Solomon C. Groff being dead the daughter-in-law brings this suit against his executors to recover the amount with interest. They plead non assumpsit and non est factum.
