Appellant, plaintiff below, instituted this action to 'recover damages for the breach of a contract, by the terms of which defendant authorized plaintiff to accept, between June 18, 1913, and December 31, 1913, subscriptions for not exceeding- 3,000 shares of defendant’s capital stock at not less than $20.00 per share, the plaintiff to receive as commission for its services the difference between the selling price and $16,00 per share.
