It is substantially alleged in the petition in this action that in the year 1895, the plaintiff, Smith, was the owner of a stallion known as Imp. Deceiver; and that the defendants, George L. and Eva M. Robertson, were the owners of a chestnut mare, and that by agreement between plaintiff and defendants said mare was bred to the said stallion, and that by. the terms of said agreement defendants promised and agreed to pay plaintiff the sum of $150 for the services of said stallion, to be due and payable when said mare had a foal by said stallion;…
