This is an application for a mandamus, to be directed to the District Judge of the Fourth Judicial District, commanding him to sign the bill of exceptions filed with the Clerk; and the facts upon which the application is based are briefly thesó: After the conviction of the defendant, the statutory time for the preparation of a bill of exceptions was extended until and including the 3d day of December, 1859.
