MEMORANDUM OPINION AND ORDER
KANE, District Judge.
This is a diversity action by the Board of County Commissioners of Larimer County, Colorado, against Guarantee Insurance Company, a New Jersey corporation with its principal place of business in New Jersey. The case is before the court on cross-motions for summary judgment on the question whether the attorneys fees award in a civil rights action to the plaintiff’s attorneys and court costs are covered by the insurance policy.
