This action was commenced in the district court of Pon-totoc county by the defendant in error to recover from the plaintiff in error for damages alleged to have been sustained by the defendant in error by falling into- an open catch-basin or sinlc-hole of the sewer system of the plaintiff in error. The parties will hereinafter be designated as they appeared in the court below. The plaintiff alleged that on August 1, 1913, he was in the city of Ada, crossing Broadway street in said city; that he had lost the sight of one eye and the vision of the other eye was affected;…
