Upon the trial of an action of assumpsit brought by the Fayette National Bank against C. G. Summers, there was a verdict and judgment for the defendant, and the case is before us upon a writ of error allowed by one of the judges of this court.

The plaintiff, to maintain the issues at the trial, introduced a check drawn on the Pulaski National Bank by C. G. Summers, to the order of John T. Hughes, for $500.00, dated October 26, 1903. This check was endorsed by Hughes to the Fayette National Bank, and when presented for payment was duly protested. It…
