MEMORANDUM OPINION
PAYNE, District Judge.
This case is before the Court on the motion of the United States to withdraw a previously filed motion for reduction of sentence, under Fed.R.Crim.P. 35(b), as to Erskine LaRue Hartwell (“Hartwell”). The motion has been fully briefed and counsel have argued their respective positions. For the reasons explained below, the Motion to Withdraw Motion for Reduction of Sentence of the United States is granted.
