Jaime Padilla appeals the 210-month sentence imposed upon him following his guilty plea to three drug counts. Padilla had entered into a cooperation agreement with the Government, pledging assistance in the investigation and prosecution of others, and the Government had filed a motion under Section 5K1.1 of the sentencing guidelines and 18 U.S.C. § 3553(e) (1994) for a downward departure. Padilla failed to appear at his original sentencing hearing. He was apprehended about four months later after he sold two bags of crack and pleaded guilty to state drug charges…
