Plaintiff/Appellee Howard Chabner brought suit against DefendanVAppellant United of Omaha Insurance Company (“United”) for alleged violations of the Americans with Disabilities Act (“ADA”) and of various California state laws. Chabner, who is disabled, claims that United unfairly discriminated against him by offering him a life insurance policy that substantially overcharged him for any increased mortality risk associated with his disability.
