After a jury trial, the defendant, an Hispanic male, was convicted of aggravated rape, robbery, breaking and entering, and assault and battery. The Appeals Court affirmed the convictions, 20 Mass. App. Ct. 965 (1985), and thereafter the defendant filed several motions including a motion for a new trial which he filed in 1989. That motion was denied by the trial judge, and the defendant appealed. We transferred the case from the Appeals Court to this court on our own motion. We now vacate the order denying the motion for a new trial and remand this case to the Superior Court for an evidentiary…
