Appeal from a pro forma judgment of the Baltimore City Court.

The appellants, who are receivers of the South Baltimore Bank, sued the appellee, who was a stockholder in that bank, to recover a sum equal to the par value of the stock held by him, under a provision in the charter, as amended by Chapter 294 of the Acts of 1888, which is as follows : “ The continuance of this corporation shall be on the condition that the stockholders and directors of this corporation shall be liable to the amount of their respective share or shares of stock in this corporation, for all of its debts and liabilities upon note, bill or otherwise.” The declaration alleges that…
