OPINION & ORDER

LEVAL, District Judge.

Defendants move to dismiss Count IV of the complaint. Plaintiff moves to compel production of a report prepared by defendants, and defendants seek a protective order against its production.

Plaintiff is General William C. Westmore-land, who was the commander of the United States Army in Vietnam from 1964 to 1968. He brings this action against defendant CBS, Inc. and others, alleging libel.
