It is hereby ordered that the order and judgment so appealed from is unanimously modified on the law by granting that part *1645of the motion seeking summary judgment dismissing the eighth cause of action and vacating the jury award on that cause of action, and as modified the order and judgment is affirmed without costs, and the matter is remitted for recalculation of the final judgment.
