This is an appeal by all parties from a declaratory judgment arising out of an attorney’s fees contract between Walter P. Brenan, Esq., hereinafter called plaintiff, and Daniel A. LaMotte and wife, Rose Miller LaMotte, hereinafter called defendants. The trial court held that under the terms of such contract plaintiff was entitled to be paid an amount equal to one-third of the net value of the testamentary assets on hand in the estate of Sophia E.
