OPINION AND ORDER TO REMAND

HEAD, Chief Judge.

This is an appeal from the Bankruptcy Court’s denial of an application to compro mise. Ben Floyd, the trustee in bankruptcy, and J. Mitchell Clark who previously represented Waiono Plantation, Inc., submitted for approval to the Bankruptcy Court a compromise of a claim Clark maintains against his former client Waiono Plantation, Inc. The Bankruptcy Court denied approval and Floyd and Clark appealed.

Having considered the record and legal arguments, the Court reverses the Bankruptcy Court’s order and remands the matter for reconsideration.
