This is an application for an order pursuant to article 78 of the Civil Practice Act directing the board of education of the city of New York to obey an order of the State Commissioner *971of Education made on the 8th day of December, 1939, to “ forthwith appoint Frank A. Craig to the position of Chief Attendance Officer in the Bureau of Compulsory Education, School Census and Child Welfare, said Craig having been duly nominated by the Board of Superintendents pursuant to the provisions of statute.”
