EISMANN, Justice.

Gooding County appeals a partial summary judgment declaring its confined animal feeding ordinance void. We reverse and remand for further proceedings.

I. FACTS AND PROCEDURAL HISTORY

On January 11, 2000, Gooding County filed a complaint for injunctive relief against Steve and Darla Wybenga (Wybengas).
