Fresohi, City Magistrate:

This case was heard by me originally on a summons. Later a complaint was filed, and a warrant issued. The defendant requested an immediate trial and he was adjudged guilty. *238Thereafter counsel appeared on the day set for sentence, and although given an opportunity to adduce additional evidence,, he did not avail himself of it, hut filed instead a brief on a, motion to arrest judgment herein because as he states, the facts, charged do not constitute a crime.
