OPINION OF THE COURT

BRESLIN, Senior Judge:

The appellant was charged with the wrongful use of methylenedioxy-methamphetamine (also known as MDMA, or “ecstasy”) on divers occasions between 1 April and 18 July 2000, and distribution of ecstasy during that period, in violation of Article 112a, UCMJ, 10 U.S.C. § 912a. He pled not guilty. The general court-martial, composed of officer and enlisted members, found the appellant guilty of wrongfully using ecstasy, but excepted the words, “on divers occasions,” and substituted the words, “on one occasion.” The court-martial acquitted the appellant of…
