The defendant (plaintiff in error) lived in the town of Franklin, and had conducted a jewelry store there under the style of “Powell Bros., Jewelers.”

Soon after the Christmas of 1925, he determined to discontinue the sale of jewelry and to confine himself to the sale of general merchandise, and advertised that fact. To emphasize this change in the character of his business the name “Powell’s Style Bazaar” was given to the new enterprise.
