On October 23, 2006, pursuant to 42 U.S.C. § 1983, plaintiffs John Mangino (“Mr. Mangino”) and Elaine Mangino (“Ms. Mangino”) (together “plaintiffs”) brought this action against defendants Incorporated Village of Patchogue (“the Village” or “Patchogue”), Fire Marshall John P.
