This is an application for discharge from imprisonment in the penitentiary on the part of Xenophon Jones.
It is averred in the petition that on the 7th day of July, 1921, he was convicted in the district court of Muskogee county of manslaughter in the first degree, and was sentenced to imprisonment in the state penitentiary for a term of 25 years; that he is now confined in said penitentiary by the warden, J. H. Townsend, under said judgment and commitment; that on the 23d day of October, 1923, J. C. Walton, who was then Governor of the state of Oklahoma, by virtue of the power and authority…
