— This is a proceeding by habeas'corpus, on the part of John Reno, who alleges in his petition that, on' the 16th day of January, 1868, he was convicted-by the circuit court of Daviess county of burglary and larceny, and his punishment assessed at twenty-five years imprisonment in the penitentiary; that he is now confined in said penitentiary by the warden thereof, under said judgment and commitment; that on the 8th day of January, 1873, his sentence and punishment was commuted to ten years imprisonment by B.
