MEMORANDUM OPINION

This matter came before the Court on plaintiff s motion for summary judgment pursuant to Fed. R. Civ. P. 56, dated May 29, 1996. Defendant’s response in opposition to plaintiffs motion was filed on September 5, 1997. Seven (7) years after the filing of the complaint, on February 9, 2001, the defendant filed a motion for leave of court to file a first amended answer, in order to assert the affirmative defense of the statute of frauds.
