Appeal from the Superior Court of Chicago; the Hon. John M. Wilson, Chief Justice, presiding. This was an action of forcible detainer, brought by John Parker, before a justice of the peace of Cook county, against Charles M. Chadwick, to recover the possession of a house and lot in the city of Chicago. On the 2d of April, 1866, a trial was had, resulting in a judgment in favor of defendant. The case was removed by appeal to the Superior Court of Chicago.

This was an action of forcible detainer, brought before a justice of the peace, for the recovery of the possession of a house in Chicago; it was tried before him, and removed by appeal to the Superior Court; and an appeal is prosecuted to this court, from the judgment rendered on the trial in that court. It appears, that the lease was for a term of five years, commencing on the 5th day of July, 1865, and ending on the corresponding day of July, 1870, at a rent of $541.66f, monthly, in advance.
