This is an appeal by the defendant from a judgment of conviction and from an order denying his motion for a new trial. By an indictment of the grand jury of Sacramento County the defendant and Joseph Tánico were charged with the murder of H. J. Litzberg on the seventeenth day of April, 1925. The defendant herein was apprehended and brought to trial but Tanko is still at large. The jury returned the following verdict: “We, the jury in the above-entitled cause, find the defendant Floyd Hall guilty of the crime of murder as charged in the indictment, of the first degree.
