This case comes before us on the defendant’s exception to the denial by the superior court of his motion for funds to prosecute a bill of exceptions.

The defendant, an indigent prisoner, represented by counsel appointed by the court, was convicted by a jury of breaking and eutering in the night time and larceny. A motion for a new trial was denied. The defendant then moved that the court grant him funds to prosecute a bill of exceptions.
