— This was a prosecution for murder in the first degree, originating in the Montgomery Circuit Court,, from which a change of venue was taken to the Parke Circuit Court. The indictment was in five counts, each charging the appellant, Joseph Stout, with having, on the 24th day of November, 1882, feloniously killed and murdered one Taylor Dunbar, in Montgomery county. Upon several motions to quash each count, all the counts of the indictment were held to be sufficient.
