Stephen Miller sued his former employer, Metrocare Services (“Metrocare”), alleging violations of the FLSA, the FMLA, the ADA, and the Texas Commission on Human Rights Act. Later, Miller amended his complaint to name additional defendants and to add a § 1983 procedural due process claim and a Texas Health & Safety Code § 161.134 claim. The district court dismissed Miller’s Texas Health & Safety Code claim via Rule 12(b)(1) and granted summary judgment for the defendants on all other claims.
