VIOLETTE, Justice.

After a jury trial in the Superior Court, Somerset County, the defendant was convicted of operating a motor vehicle after his right to operate had been revoked because he was a habitual offender, 29 M.R. S.A. § 2298 (Supp.1984), and operating a motor vehicle while under the influence of intoxicating liquor, 29 M.R.S.A. § 1312-B (Supp.1984). The sole issue on appeal is whether the trial court erred when it refused to instruct the jury on the competing harms defense, 17-A M.R.S.A. § 103 (1983).
