On February 21, 1941, Zeb B. Jones, appellant (hereinafter called Jones), filed a complaint in the Superior Court of Greene County, North Carolina, against the Bankers Life Company, appellee (hereinafter called Company), alleging that during the month of March, 1936, the Company, in violation of the promises of its agent, Baker, had (1) wrongfully and fraudulently failed to deliver a $5,000 insurance policy on Jones’ life, (2) wrongfully and fraudulently cancelled this policy after its issuance, and (3) without the knowledge or consent of Jones, re-issued and delivered…
