This matter is before the court on plaintiff First National Insurance Company of America’s (“First National”) motion for preliminary injunction. Defendants filed a response in opposition, to which First National replied.
I. BACKGROUND
Defendant Sappah Brothers, Inc. (“Sap-pah Brothers”) is a general contractor. (Compl. ¶ 15; Answer ¶ 15.) At Sappah Brothers’ request, First National provided payment and performance bonds on its behalf for various public construction projects.
