In People v. Eckley, Jefferson County District Court Case No. 84CR1046, and People v. Carroll, Adams County District Court Case No. 86CR1386, the trial courts entered judgments dismissing charges filed against defendants Gordon E. Eckley (Eckley), Marian M. Eckley, The Denver Real Estate Company (Denver Real Estate), and William R. Carroll in reliance on this court’s decision in People v. Bagby, 734 P.2d 1059 (Colo.1987).
