The opinion of the court was delivered by This is a case which was brought by the appellee in Oklahoma county to recover of the defendant $263.25 for the non-delivery of a tool chest and contents. A trial was had, a verdict and judgment rendered for the appellee for that sum. The plaintiff brings the case here on appeal and asks for a reversal of the judgment for various reasons, only one of which it will be necessary to notice.
