On October 21. 1929. Mrs. Ruth Leigh Farrell, a young woman, was struck and fatally injured by an automobile owned and driven by Buford Potts while he was engaged in delivering messages as an employee of the "Western Union Telegraph Company. Her father qualified as administrator of her estate and brought this action for damages against Buford Potts and the Western Union Telegraph Company. The Company paid the administrator $3750 and the action was voluntarily dismissed as to it under an agreement which is a subject of controversy. The cause went to trial to a jury before the Circuit…
