This is an application by the defendant, who is charged with two counts of murder in the first degree and three counts of murder in the second degree, based upon a concept of heightened due process inherent in a potential death penalty case, (1) for an order prohibiting the prosecutor from issuing subpoenas duces tecum for the production of any records pertaining to the defendant without notice and an opportunity to be heard, or in the alternative, to maintain a complete record of all such subpoenas so issued for the purpose of possible appellate review,…
