This is an employment action in which plaintiff alleges that defendant violated plaintiffs rights under the Family and Medical Leave Act (“FMLA”), 29 U.S.C. § 2601 et seq., by using- FMLA-protected leave as a factor in disciplining plaintiff and ultimately terminating his employment and by retaliating against plaintiff for his exercise of his rights under the FMLA.
