The appeal is from a judgment entered in favor of the defendant in an action brought by the plaintiff to recover certain money paid to the defendant on the monthly installment plan, under a contract for the purchase of two lots, on the ground. that the defendant had breached the contract, in that it had failed to put in the street improvements as agreed within the time specified. After judgment the plaintiff moved for a new trial, which motion was denied. The plaintiff thereupon took this appeal.
