GILBERT, Circuit Judge.
For alienating his wife’s affections and debauching her the defendant in error obtained a judgment against the plaintiff in error for the sum of $9,125 and costs. Error is assigned to the instruction to the jury permitting them to award punitive damages. It is the general rule that damages which may be recovered in this class of cases are exemplary rather than compensatory. 21 Cyc. 1628; 8 Am. & Eng. Enc. of Law (2d Ed.) 266. And the Supreme Court has said, in Day v. Woodworth, 13 How. 371, 14 L. Ed. 181:
